1. Acceptance of These Terms
By accessing or using the MyBallot mobile or web application (collectively, the “App”), you (“User” or “you”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to all of these Terms, do not access or use the App.
2. Purpose of the App
MyBallot is a non‑partisan voter‑education tool designed primarily for residents of East Baton Rouge Parish, Louisiana. It provides election information, candidate and ballot‑measure details, comparison tools, personalized sample ballots, reminder functionality, and a Q&A feature. MyBallot is not an official election authority and does not provide legal advice.
3. Eligibility & User Accounts
- Minimum Age. You must be at least 13 years old to use the App.
- Account Creation. Certain features require registration. You agree to provide accurate, complete, and current information and to maintain and promptly update it.
- Account Security. You are responsible for safeguarding your login credentials. Notify us immediately of any unauthorized use or security breach.
- One Account Rule. You may not maintain more than one account without our express consent.
4. License & User Responsibilities
- License. Subject to compliance with these Terms, MyBallot grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the App for personal, non‑commercial purposes.
- Prohibited Conduct. You agree not to:
- Use the App for any unlawful, fraudulent, or harmful purpose;
- Harvest or scrape data, or attempt automated access (e.g., bots, crawlers);
- Upload or transmit viruses or other malicious code;
- Interfere with or disrupt the App or its servers;
- Reverse engineer, decompile, or otherwise attempt to derive source code; or
- Violate any applicable laws or third‑party rights.
- User Content. You retain ownership of content you submit (e.g., private notes). By submitting content, you grant MyBallot a worldwide, royalty‑free license to process and display that content solely to provide the App’s functionality.
5. Intellectual Property
All content and software in the App, including but not limited to text, graphics, logos, icons, images, and code, are the exclusive property of MyBallot or its licensors and are protected by U.S. and international intellectual‑property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from any part of the App.
6. Third‑Party Services & Content
The App integrates or links to third‑party services (e.g., social‑login providers, Google Gemini API, official election websites). MyBallot does not control and is not responsible for third‑party content or services. Your interactions with third parties are governed by their own terms.
7. Disclaimers
- Informational Purposes Only. The App’s content is provided for general informational purposes and should not be relied upon as official or legal advice.
- No Guarantee of Accuracy. While we strive for accuracy, election information, candidate data, and AI‑generated responses may contain errors or omissions. Always confirm with official election sources.
- Reminder Functionality. Voting reminders are provided as a courtesy. MyBallot is not liable if you fail to receive a reminder or miss an election deadline.
- AI Content. Q&A responses generated via the Gemini API are machine‑generated and may be inaccurate or outdated.
- AS‑IS Service. The App is provided “as‑is” and “as available” without warranties of any kind, whether express or implied.
8. Limitation of Liability
To the fullest extent permitted by law, MyBallot, its officers, directors, employees, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the App, even if advised of the possibility of such damages. In no event will MyBallot’s total liability exceed one hundred U.S. dollars (US $100).
9. Indemnification
You agree to indemnify, defend, and hold harmless MyBallot and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.
10. Suspension & Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the App or other users. Upon termination, your license to use the App will immediately cease.
11. Modifications to the App & Terms
We reserve the right to modify or discontinue the App—or to update these Terms—at any time. We will notify you of material changes by posting the new Terms within the App or by email. Continued use after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
- Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Louisiana, U.S.A., without regard to conflict‑of‑law principles.
- Informal Resolution. Before initiating formal proceedings, you agree to contact us to attempt to resolve any dispute informally.
- Arbitration. Any dispute not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will occur in Baton Rouge, Louisiana.
- Class Action Waiver. You and MyBallot agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Certain jurisdictions may not allow mandatory arbitration or class‑action waivers; if unenforceable, the dispute provisions will be severed as necessary.
13. Severability
If any provision of these Terms is held unlawful or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between you and MyBallot regarding your use of the App and supersede any prior agreements or understandings, whether oral or written.
